With the globalization of economic processes accelerated economic, growth is impossible without the innovations that are the key to competitiveness of the economy on a global scale. The basic condition of innovative economic development is the effective functioning of the Institute of Intellectual Property.
Recognizing the importance of intellectual property for the development of an innovative economy, the Russian Federation pays particular attention to enhancing the functioning of the Institute of Intellectual Property. The strategy of innovative development of the Russian Federation for the period up to 2020, approved by Decree of the Government of the Russian Federation of December 8, 2011 № 2227-p (hereinafter – the Strategy), the state program of the Russian Federation "Economic development and innovative economy" is supposed to implement a series of measures aimed at improving effective protection of intellectual property, promoting the commercialization of intellectual property (hereinafter – RID).
The strategy aims to solve large-scale problems in the field of intellectual property. In particular, it provides a target indicator "coefficient of inventive activity", which is expected to increase from 2.0 in 2010 to 2.8 in 2020. Another indicator of the target implementation of the Strategy is to increase by 2020 the number of registered contracts of alienation of rights to patents and licensing agreements up to 40 thousand a year, which allows predicting the corresponding growth in registered contracts for all industrial property at least 14 times.
At the same time, the current practice is not enough evidence of the effective functioning of the Institute of Intellectual Property. Despite the significant amount of public investment in research and innovation, there are several problems hindering the development of the intellectual property market in Russia: inefficient use of established public RID funds which make a large share of the total created by RID in the country; Low inventive and patenting activity of business entities, including abroad; Depending on the growth of the Russian economy on foreign technology. As a consequence, the existing regime of intellectual property management does not fully take into account the need to improve implementation of the functions assigned to the state in this area.
Regulation in the field of intellectual property currently has to take into account the modern challenges of reality: the globalization of markets for goods, works, and services which entails the expansion of demand for legal protection of RID abroad and expansion of international mechanisms for the protection of intellectual property; growth and continuous improvement of information technology which leads to the need to develop mechanisms for the protection of exclusive rights in the digital environment.
